Pittsburgh – Police and County Prosecutors were sued by a man from western Pennsylvania who claimed that he was run over by a DUI while he was under the police custody and his hands were tied.

Police identified as Jerry Ray, age 48, resident of Pittsburgh, was arrested as he was suspected drunken driving on the 16th of October last 2011. According to the lawyer of Ray, he had his hand in cuffed while authorities laid him down along a traffic lane at a major downtown corner at about 2:15 o’clock in the morning.

Based on their own report, when he was in custody, they laid him in the street and had him run over by a drunk driver.

Ray was airlifted to a hospital in Pittsburgh where the serious injuries of his head, face and hips; including some post-concussion issues. The DUI driver was sentenced only one year of probation.

The police in Washington, Pa. was sued by Ray for he was run over while under in custody. Aside from the police, he is also suing the District Attorney’s County Office as the prosecutors allegedly failed to ask him about a plea agreement. They have entered the drunken driving case against the man who ran him over. Ray contended that his right as a victim was violated for his consent was not even asked. According to the lawsuit and online court records, they also allowed the motorist to enter a special probation program that could eventually allow his record to be expunged, according to the lawsuit and online court records.

His lawyer said that the bottom line was that he was run over after he was placed in custody.

The police identified the car of the driver as a “Unit 1” and the handcuffed in Ray’s body as “Unit 2.” Police report described the incident in one sentence while they were investigating what happened and why.

The lawyer continued that although his client was arrested, he was never charged the court records confirmed.

The other DUI driver was assigned a program that was generally reserved for first offenders after he appeared last year in Washington County Common Pleas Court.

Don Zettlemoyer, who is the director of the Justice & Safety Institute at Penn State University, stated that the key issue was how long police placed the handcuff in the street.

Zettlemoyer said if Ray was run over as he was being cuffed, police had no control to avoid the accident. Still, the law is clear that once you place a person in the custody of a person/agency; the responsibility for their safety is yours.

Defense lawyer insisted however, that the accident took place and the police did not certainly move fast enough.
